No justice in Pennsylvania with good old boys system

I found this story in the Times Leader of Pennsylvania. The author, Joseph Novak of Larskville, tells the story of what many people involved in Monroe County Court are currently experiencing. Before I add my story, I think this is a good precursor to the problems that exist when people try to get justice from the ones who are supposed to be responsible for overseeing corruption in the court system in Pennsylvania.

Letter to the editor

When you file a complaint against a lawyer or a judge, they're not going to do anything about my complaint or yours because they are not going to go against their buddies.

Why? Because it is one big, good-old buddies, clique-club. I filed a complaint against an attorney up here for falsifying, withholding and tampering with evidence and perjury and the ethics committee sent me a reply stating that, yes, the attorney made a lot of mistakes, but they said they have no control over what he did.

So why have an ethics committee?

I also sent the judicial conduct board a complaint against the judge who heard the case with the same charges as the lawyer, and guess what? They sent me a response stating that the judge did nothing wrong. I sent them a copy of the evidence showing them what the judge did wrong and once again they protected one of their good old boys in the clique.

I feel a panel of everyday people should hear these charges against the judge or lawyer and not the good-old-boy clique.

Monroe County has a horrible and bad reputation for allowing child molesters access to children. I've heard and read a lot of stuff about this in that area. You can even Google the county to get the info. That judge Mark Pazuhanich that molested his 10-year-old daughter at the Hilary Duff concert was still allowed to stay on the bench until he pleaded out and is now a registered sex offender. The senior judge in the court said the judge just made a mistake. Imagine that?! He molested his kid in public and had to be pounced on by security guards and then arrested by the cops but the general feeling in the court was protect one of their own.

You are so right about Monroe County. THEY SHOULD RENAME THAT COURTHOUSE "THE COURTHOUSE OF CORRUPTION."

My children and I have been drowning in it for more than 7 years. I've been thrown into the fight of my life and my children's life against the children's child molester father who is a seriously psychotic person. The court initially put him in therapy for some bogus period of time and then gave him unsupervised access to my innocent children.

I've met many others (some men and many women) who are facing the same or similar problems with the Monroe County Court. I keep waiting for the class action lawsuit that is sure to come, but the victims of this corruption will have to take it to federal court since they'll face the good old boys system that control Pennsylvania. The judges and lawyers in that county are crooked, corrupt, and unaccountable. Court officials will use the system to retaliate against you if you challenge them. You ask how? If you are poor, they'll make you spend money that you haven't earned yet on court-ordered social workers, over and over again, court-ordered psychological evaluations, over and over again, court-ordered home studies (they contract out this job to another group that the poor people support, the local Catholic Social Services); if you attempt to get child support for the kids who were molested and mentally abused after living in dysfunctional homes, well, they'll use the benchmark of what you earned a long time ago and then use that forever as they compute how the child molester/abuser supports the kids he molested. And they do this even as there are no industries, no jobs in the area where people can work to pay the court officials salaries and all the other court-ordered, so-called professionals holding their hands out to you as you pay them from your minimum wage jobs. A single mother will have to have a major resolve to protect her children from a criminal who the court refuses to punish or die a slow death as she gives in to the stress of fighting the court to protect the children she gave life to. It's devastating! They punish poor women for not staying with abusive, child molester husbands or boyfriends. These dictators want you to follow their logic on so-called "family values" but you'd have to be inbred and psychotic to accept their definition of "family values" when it includes so much pain that a woman and her children must bear just to stay in the family way.

NEW YORKERS ARE IN FOR THE MOST DEVASTATING TIME OF THEIR LIVES IF THEY MOVE TO THE POCONOS AND HAVE TO DEAL WITH THE MOM AND POPS STOREFRONT THAT OPERATES AS A COURTHOUSE.

Some of the judges were lawyers in the area and show preferential treatment to some other lawyers who come before them. They received tons of money from other lawyers and small businesses when they were running for judgeship and now it's payback time. They have different sets of laws for themselves than they do the people who come before them in court. For example, I heard about one of their crooked and corrupt lawyers who lied in a petition about a judge's (from another county) court order but nothing was ever done about this lawyer. In fact, the judge not only let him get away with it, he allowed his child molester client access to innocent children.

Nobody challenges the clan of corruption. It seems like some people have information on some of the judges and court officials or gave a lot of money to some people when they were running for judge or before they became conciliators. One local person who says he's also fighting the system told me that some of these people are drug addicts and have information on each other so if one violates the law, the druggie court official can't do anything about it.

The whole state is filled with right wing politicians that have been taking the people to the cleaners for many years. You can end up spending so much money on lawyers, and since they are a part of the corruption, they don't ever challenge the court that feeds them. Lawyers, court-appointed social workers/psychologists, all get rich off of the poor people. You can end up being ordered to spend money on these court-appointed people over and over again--thousands and thousands of dollars. It's a huge money-making scheme for particular professions. There's little other ways to make a living there anyway. And they know that these people will sell their homes to fight to protect their children except the joke is on these poor schmucks who just keep twisting in the wind when they hire a Monroe lawyer.

You get no justice if you complain to the Supreme Court about a lawyer violating the law or his corrupt behavior (they are in the good old boys club); you get no justice from the Judicial Boards (they know some of the judges personally; they are a part of the crooked network).

Some say these people are Nazi descendants with iron-clad control over the little, isolated, Poconos vacation town--the ones controlling the people's lives in the court system and political offices are the corrupt, cheats, scammers, and crooks. No one in Harrisburg cares about what goes on in the Poconos, and tourists keep pouring money into the town not knowing the corruption that they are supporting.

Some people believe once more NJ and NY people move to the area, they'll start to feel the squeeze and it will be a major fight. People will not tolerate the intolerable corruption/croynism when they are forced to deal with the court. IT'S TOO BLATANT AND IN YOUR FACE. The conciliators are hired for life like the Supreme Court Justices. The senior conciliator there acts like he's the head Gestapo. He overseas court cases before it gets to the judges and whatever he says is pretty much a done deal. He tells a judge how he wants it to go and the rest is history. Trying to get justice in a child custody hearing thereafter is a joke. If you challenge these guys, they will retaliate and you better have money to get a big shot lawyer out of town.

They (old timers and the rest of their generation) hate people from New York. They advertise a lot in New York for people to come spend their monies on new homes and support their lack of industry and tax infrastructure but they hate New Yorkers. They blame them for everything that is wrong with the area. New Yorkers get blamed for heavy traffic, gangs, violence, drugs. Except, they had generations of people on drugs and committing violence, and killing people in traffic accidents due to drunk driving way before New Yorkers started moving in. The average town's people are generally decent and many of them are people from outside of the area.

There's also the fact that the Ku Klux Klan is rampant in these rural areas. They have meetings routinely in specific towns (it's a well known thing). The KKK are a part of the judicial systems. Before New Yorkers and anyone else move to the Poconos, they should do some research. They will be shocked when they see how many confederate flags are on cars and front doors in the area (no doubt, they probably keep the Nazi swastikas on their bedroom walls). New Yorkers are not used to that sort of thing and that is just the basic mentality of the people in Monroe County and other rural parts of Pennsylvania.

New Yorkers and others who move to Monroe will have to get used the idea of having to deal with people in the court system like judge Pazuhanich (child molester judge now a registered sex offender), judge W. (people say she's a high society judge with big family name who loathes the little people who come before her, especially poor, single mothers, divorced mothers, and black people; she constantly prevents abused women/moms from getting protection from abuse court orders, PFAs, from their abusive and psychotic partners; but there's another female on the bench who some claims is worse than judge W. when it comes to not granting PFAs to people who need them). Another Monroe judge defeated the only Democrat that was running in the election for judge. People say his wife joined membership with a certain group, and some people in the group were secretly scandalizing the Democratic candidate by telling people/other members things about the woman and her husband (she's getting a divorce, she has no kids so how can she be judge in child custody cases? etc., etc.,) They played hardball even though they're supposed to be a neutral organization (I guess you could call them the good old girls network). The judge made himself a household name brand in the area. Forget about justice, just join the croynie groups and you'll be A-Okay.

Reports show that there are now more Democrats in the area than Republicans; however, the Republicans usually win in major and local elections in the area, which is remarkable considering the major turnout of Democratic voters in the last major election. These good old boys, who just happen to be of the right wing persuasion, appear to have the polling booths rigged. The judges of elections (JOEs) are racist and give New Yorkers and African Americans a hard time when they attempt to seek help at the polling booths from the supposed helpers there. If they perceive someone to be voting a certain way, depending on race or where he or she moved from, they'll give that person a hard time. They give them incorrect information and turn them away. If any Democrat expects to ever win in Monroe or other rural areas in Pennsylvania, they'd better check the voting machines and check on who's actually doing the counting! It's not like Philly or Harrisburg elections or other non-rural areas, but who knows how far the good old boys stretch. In fact, it's certain they have croynies in the cities too. It seems clear that Casey's win with his pro-life position helped him beat Rick Santorum (although, Santorum's comfort level with Bush didn't help him much). And it seems like Rendell had no real opponent, and coming off of the Bush debacles, he was a shoe-in anyway. Things are just not very transparent or it is transparently clear that something is very wrong with the characters responsible for monitoring the polling booths.

There's scandal after scandal, but nothing ever gets done about it. The only guy who "seems" to give a damn is Assistant District Attorney Michael Rakaczewski. He's young and seems to want to get his job done right (for some strange reason and in that climate of corruption). But, the courthouse is another thing all together.

The child protective group (C&Y) is a joke. There are tales after tales of their negligence that cause kids to die. One of the most recent was a 12-year-old little girl who was shot to death by her father. Children and Youth did nothing to protect her even though there were many complaints about the father. The father had sexually abused his son in the past. It was a surprise that the local TV news told the story and they actually mentioned that people had been complaining to C&Y about the father's behavior. The local TV news (channel 13) even bothered to check with the police statistics on sex crimes and reported that it's the worst it's ever been this summer.

There's no justice to be had in Monroe County and the people deserve a transparency of justice in their elected officials. These people (judicial officials) wear the badge of entitlement as good as the likes of any true dictatorship.

It's been hell trying to get justice in Monroe County! Some of what you experienced is my own experience with that corrupt court system.

Child molesters, batterers, psychotic people run the place. It's like the nuts are in charge of the nut house and have all the control over the lives of regular people.

I found this on the Web by a PA attorney who I'm sure doesn't work in Monroe County:

I'm a Pennsylvania attorney who had the utter displeasure of dealing with former Monroe County District Attorney Pazuhanich. He has since become a judge and been charged with sexually molesting his 10 year-old relative.

The first time I saw him he struck me as a total no-good-nik. Then I read some articles that had been written about him in the Pocono Record.

In the late 1980s or early 1990s Pazuhanich, as a DA, charged a 9 year-old boy with murder and wanted to try him as an adult. Judge Ronald Vican, President Judge of Monroe County Court of Common Pleas, supported Pazuhanich in his quest and even wrote an opinion in the case citing "legal rational" for trying a 9 year-old in adult criminal court. If the case had gone to trial and the 9 year-old had been convicted, would the boy have been sentenced to death? Would he have been sent to SCI-Camp Hill for "classification?"

When Pazuhanich was running for Monroe County DA in the 1990s, his campaign promise was to try more death penalty cases. Of course, he won the election!. So, whether warranted or not, (under Pennsylvania's enumerated aggravating circumstances) many defendants were being tried for capital murder and facing the death penalty in Monroe County. The frequency with which death penalty cases were being tried in Monroe County from 1998 to 2001 was astonishing! Like it was Philly!

DA Pazuhanich and Monroe County were frequent recipients of state monies from the state Attorney General's office (circa 1996- 2000) for the big war on drugs. The only problem was, the site of the big drug raids would be shut down at the time of the raid, but reopened again in about a year. Drug dealers would set up shop there, then the place would be raided. They shut down and soon reopened.

There's lots more, an illegal search and seizure on a Greyhound bus, for example. Hey, check out the Pocono Record archives, allegations of child molestation might not seem so surprising.

Have you ever noticed how the most extreme law-n-order types are often the ones doing the most wrong themselves?

Hello all,

All of you have hit the nail on the head.

I am having trouble sleeping...I realized the only way I'm going to be able to write my story is to just do it. It's so hard to explain. I am struggling with trying to understand what has happened to me and my daughter inside of Monroe County Court.

They have caused us so much pain in addition to what the man I was married to has. I feel like I can't trust anyone anymore; the pain is very bad physically. The depression is not good either. Let's leave it at that. I'm not feeling sorry for myself. I've been trying really, really hard to stay positive and get back on my feet again, but it's a very difficult thing to do. It's hard to believe that someone can do another so much harm yet is able to gain support to continue to harm from a court system that is supposed to protect people. I am a good person. I really care about people; I care about the wrong of injustice; I care about abused children and the people who try to protect them. I've always spent my life trying to make a difference.

I try to help people free themselves from whatever ails them but I can't seem to do that for myself and my daughter within this corrupt court system. I've been to a therapist who believes that my child custody case has taken a toll on my health and mental state. It can do that to you to watch deliberate destruction of your life by people in authoritative positions. She said I have to put myself before my child custody case right now or I will be no longer here. But I asked her how do I do that? How can I help myself when I can't even protect my daughter from her abusive father? He beat me for many years. Our daughter watched in horror. More than a few times, on his way to attacking me, he shoved her across the room, just to get to me. He didn't even bother to look back at her to see if she was okay. A few times, I begged him to let me help her while she laid crying on the floor, but all he wanted to do was to beat me. A few broken ribs, broken cheek bones, broken arm later, he now has custody of our daughter. What's wrong with the people who believe a man can beat up his wife but won't beat up his child/children? The same energy and lack of morality he used to beat up someone helpless or who can't fight him back still exist. The key is that he knows that he's stronger and his victims can't fight back; can't hurt the way he hurts; can't protect themselves from him. He gets a thrill from knowing he can control someone that much because he has no control over his own life. That's power! That's something that he continues to crave. That's something he can't get enough of, from a woman or children.

I purchased a gun and got the license for it out of fear of the next time that he would, again, try to kill me. But that didn't work because I couldn't harm anyone even if they were about to kill me. Besides, I never bothered to buy ammunition to go with the gun. It was supposed to make me feel safer. It was supposed to make him stop. But there was no ammo. I think I would rather beg him to kill me instead if it meant saving him from killing my daughter. My mother, adult son, sister, my family keep telling me that I need to save myself first. I don't trust that! They want me to move to another state where they live, but, I will not leave my daughter or do anything to put her more into the hands of this psychotic man who happens to be her father. I feel I cannot work right now. I feel trapped and disabled. But then I tell myself, yes you can; you have to. But every time I get on my feet again, he, via Monroe County Court, pulls me down again.

I told a therapist that I have severe PTSD, and she agreed. I'm trying to understand it while I'm living it. It makes me insane to even think about the child support and the pending arrest that is coming at me for not being able to pay it after he was given custody of our daughter illegally. I can't make the money that I did in New York but they still have me in their system with the same money I made back then. Every type of salary you could make in NY is cut in half in this area.

I had a gun in the house because he was going to kill me and I couldn't get a protective order against him from the court but Children and Youth (our so-called child protective service) put my daughter with the abuser and now I have to pay him child support. He is a two-time convicted felon (burglary and assault) but he still gets custody of our daughter. Now, I worry about her every day.

I've gone through 4 Monroe County lawyers and they do nothing to challenge the court system. They took my money and made promises to fight but did what they did to all those other people--NOTHING! It makes me want to curse but I don't curse. They have hurt me. The court system rolls on like a tidal wave over innocent people, especially poor mothers and children. They have no compassion; there's no justice, just blind destruction. One of the problems is that I'm having trouble processing all these feelings. Doesn't that sound so psychologically fit? That's what it does to you. You don't know if you're going or coming from one day to the next. It's like inside, I feel stupid, a failure, upset, too sensitive. How could they not see what's real? Why don't they care about how much I have suffered? Why don't they do the right thing? Why can't they help my daughter?

But I'm always afraid because I've been through so much. I'm shaking. I'm not as confident as I used to be many years before I met the man who nearly killed me or is still trying to kill me. I don't know how to get back my confidence when every time I turn around, I'm looking for a police car outside my house to come and take me to jail or waiting for my ex to come to my house at night and kill me. It's very scary.

I have 2 RN licenses--one in PA and one in NY. I'm a good mother; I'm a really good nurse; I have no record; I have a 25 year Child Abuse Clearance; I have a complete state and federal criminal background clearance. I come from intelligent parents with good values, maybe too good because I sympathized with a psychotic man and now my daughter and I are paying for it. Should we pay for it for the rest of our lives or just the rest of my life?

I am loyal and good friend; I would stop at any accident scene to help no matter how scary. I've been all over the world. I'm and avid reader, and I love children, especially my own. I've worked my buns off since I was 15. I've been treated like absolute garbage by the judges and concilliators, the police, and C&Y. No one bothered to check my ex's background. They didn't care. That C&Y person not only bought my ex-husband's manipulative drug addicted, dope fiend, lying stories, she abused me and took my daughter and gave her to him.

She ignored my calls, my pleas for her help. He has been arrested for God knows how many times yet he has custody of an innocent child. What a wonderful world we live in! C&Y, the judges, the DA, and the concilliator, they all refused to look at his arrests, his assaults on me (complete with pictures taken by NYC police). What a wonderful world Monroe County is! The Land of the Gutless Wonders--give me N.Y. any day; at least they are smart enough to recognize a criminal when they see one. On and On it goes; he has used this court system to abuse me, harass me, intimidate me, threaten me. He keeps on getting away with murder while I am running scared now. And I did nothing wrong, except I married him, so according to this sexist, Nazi, racist court system, I deserve it.

The jokes on me. I was wrong to have hope and faith in this court. It's all backwards. I was wrong because I didn't know how to be a slime-ball like him, the lawyers, and the rest of the pathetic human beings who make a living doing "so-called justice." What a joke! What a lie! I don't know what these people grew up on, but I grew up knowing that goodness and integrity are important. They are important enough to fight for and to pattern your life after.

Words like "do unto others" and "love thy neighbor" are supposed to mean something. But like Friedrich Nietzsche said, "I'm not upset that you lied to me, I'm upset that from now on I can't believe you." And I can't forget what Mother Teresa said, "I know God will not give me anything I can't handle. I just wish He didn't trust me so much."

Hold your head up! Don't go under because that's what they want. You're not a failure, the system failed you and your daughter. You're not stupid, you can see exactly what has happened and you have the courage to speak up.

I've been through the horror too. When I found out that you can't file a complaint against a Monroe County conciliator, it blew me away. The state gave them immunity so they can do whatever they like to you and your family without concern or accountability. That senior guy that one of the posters talked about cause a lot of harm to me and my son. My ex-husband is a batterer too. Our son is terrified of him. He beats his current wife too but she's too scared to get away. That conciliator put him in anger management treatment for a few weeks and then gave him access to my son. He's been angry all of his life and so this ridiculous man (Dan C.) that Monroe County put in charge of our lives put my son in the hands of a psychotic man. My present husband went ballistic inside the courthouse when he found out that this guy put my son back in danger. The man I'm married to now loves my son and it makes him angry to see the pictures of what that SOB did to me when I was married to him. And even when he was beating me, I knew I didn't deserve it.

It's really hard to accept that someone who says he loves you could beat you so viciously. It's like you are an animal and even animals are protected more than battered women and children. So I know how you feel. I've been there. And some people who talk about this like they know what it is have no idea what they are talking about. They don't know what it feels like to be that scared. They, men and women, say things like you should have left or why did you stay or why this or that? I just want to tell all the so-called experts to SHUT THE HELL UP!! Have you ever been scared out of your mind? Have you ever felt that betrayed beyond comprehension? Have you ever given up so much to support someone else? Have you ever been manipulated by someone you loved or told endless lies? Have you ever truly loved any one? Have you ever watched in horror as someone took control of your life after beating you and causing you to believe there's no way out? Have you ever been raped by your spouse? Oh, yes, you can be raped by a husband, but of course they don't call it rape if you;re married since he has that right to your body. It's insane to hear the nonsense that comes out of some people who have no idea what this experience is.

That sexist and incompetent conciliator ordered us to go into therapy with another sexist and incompetent man, social worker, Anthony Cutt... This so-called social worker was telling me that it was my fault that my ex-husband was so angry/abusive. Imagine that? He was telling me that I was making him angry enough to beat me up in front of our son and that it's my fault that my son is afraid of his father. Then he told me that I couldn't talk about anything else that my ex had done to me during the session. I filed a complaint against the social worker and yes, the good old boys of Pennsylvania put their cloak around that SOB too. They did nothing. You can imagine how many other women he's doing this to. I had heard about a case where the social worker did this to another woman. He told her that she was not allowed to talk about her children being molested by the father and about her finding him in bed naked with her son, his step-son. She told him that she thought they were there to talk about the kids. And he told her that he didn't give a damn about her kids. How outrageous is that?! So you see, it's an epidemic of sexism, racism, classism in a court that allows child endangerment in Monroe Country. It's like the little town (the Poconos) of the "stepford wives." And the nuts are truly running the nuthouse.

I've heard about poor black kids that go before the judges in Monroe and end up in prison for little and no reason. These judges and conciliators are hateful people. They destroy people's lives and it must be because they are doing the same at home to their own families. Who bothers to check their mental state (psyche)? Who knows how twisted they truly are? They sit in judgment of people but nobody knows who they are, how they were raised, and what mental problems they have. We only touch the tip of the iceberg when that Monroe judge was arrested for molesting his child.

I stopped allowing the good old boys to play Nazi games with my family's life. I hired a private detective and got some information about my ex that would put him in prison but since the court officials have shown me how sexist and corrupt they are, I handled it myself. The corrupt conciliator can order all the sleepovers he wants but my ex will not show up at my door again; he knows I know what he did. They make you have to find ways to protect your family because they get paid to do the right thing but the power makes them feel invincible, and above the law, especially since no one can even file a complaint against a conciliator or get any justice when a complaint is sent to the so-called complaint boards. Although, it doesn't matter since the good old boys protect each other anyway. But they have it so you can complain about a judge, a lawyer, a social worker, but you can't file a complaint against the people who handle the bulk of child custody cases; you can't file a complaint against the conciliators/masters. Not even the president is immune from prosecution but conciliators/masters are like supreme court justices. It's insanity!

Kindred, you probably went broke trying to protect your daughter but if you can get some help from your family, consider getting a private detective to look into the batterers transactions, past, etc. He sounds like a despicable human being and those kinds of people usually have dirty dealings that they don't want other people to know about. If you can't do that, join groups that will give you support and try really hard to not let the stress get to you where you can't function. I know it's a really difficult thing to do, but you must do it. Your daughter needs you to be strong even when you feel like letting go and giving up. No good parent can ever give up the fight to protect their children. So it becomes all about the child you gave birth to and that's where the sacrifice comes in. Your daughter didn't ask to be born, you made that choice and until she can take care of herself, it's your job to protect her. And that means by any means necessary, without putting yourself behind bars, which is where the batterer should be and the court officials that caused you and your daughter harm.

Thank you for your kind words. I'm grateful that I have a very good friend who tries to keep my spirit up when I feel really low. I will try to face the challenges ahead, not like the criminals who hurt me (my ex and the disgraceful court officials), but like a capable woman (and being a woman seems to be what they hate the most about me). I have some people who care about my survival and so I will try.

I had heard about the judge who was running as a democrat and what people were saying about her. She was a former ADA and temporarily put in office by Rendell after judge Pazuhanich went to trial. She didn't fight back the way she should've after they started saying those things about her. People say she was too worried about looking like she was like that other lawyer who was running against her because he was getting a lot of money from the local businesses. That was stupid because it didn't matter who he would be indebted to once he became judge; that's the way the business works in Monroe, other parts of PA, and Washington. But a lot of people are saying that there is no real difference between a democrat and a republican politician in Monroe County. They have the same air of racism/entitlement/corruption/unaccountability no matter what party they claim they belong to. This is one of the place where they don't advertise what party they belong to when they campaign in the area. You have to already know or go figure it out, especially after the Bush backlash and all the scandals that followed with others in the right wing party.

And one of the main problems with C&Y and the court is that there's no "real" separation between the two. C&Y won't go the distance because the culture of the court system is good old boys' male dominant and corruption. They know if they "indicate" someone for child abuse/molestation, they won't get that person "founded" by a judge or the court system, so they fall in line with the corruption and become ineffective and useless. There's a difference with other C&Y like Carbon County and Northampton. They seem to operate independently. Although, the D.A. in Northampton treats kids like adults when interviewing them after they've been abused/molested. They could have 3 to 4 adults in a room throwing questions at a 5-year-old kid just like they would an adult in an interrogation. You can imagine a child that age after they've been molested and now are faced with strangers asking painful and inquisitive questions about his or her abuser/molester. That D.A. won't take it to trial if a "win" is not certain. So that kid would end up going through the torture of abuse and get "raped" again, so to speak, in the D.A.'s office, and be put back in the hands of his or her abuser/molester. Adults in these positions need proper training. The system sucks. There's no doubt about it.

Thank you. Trust me, if you knew the whole story, you'd be horrified, although I've figured out some of the political crap over the years (not that it's done me any good). You seem to have a greater handle on the political set up/games than I do. I honestly had a difficult time understanding some of the things you were referring to. Although, I believe it!! My ex is a master manipulator...has been in the court system since he was a teenager. It was much harder for him to get over in N.Y. Here, it's a piece of cake.

Last night, it was on the news that the police was called after school buses were found painted with swastikas in Monroe (Saw Creek). Now, that should make you wonder why they would be targeting school kids. The police is supposed to be investigating. But swastikas on school buses, giving kids to abusive people, child molesters, judge molesting his own kid, corruption, sexism, racism, croynism, lawyers profiteering off of poor people, all just another day in Monroe.

HARRISBURG----Luzerne County Judge Ann H. Lokuta's former secretary testified Friday. She filed a complaint with the Pennsylvania Judicial Conduct Board to alert someone as to what was transpiring inside the walls of the 15-year jurist's chambers.
Susan Weber launched the Pennsylvania judicial Conduct Board's misconduct case against Lokuta. She also was the Board's last of 30 witnesses to take the stand in its case. Weber spent 90 minutes explaining some of the hardships she suffered at the hands of Lokuta. Lokuta badgered, berated, humiliated and scolded her almost every day over a 15-month span, Weber said. She said she felt nothing she could do was good enough for Lokuta.
"It was something that changed my life forever," Weber said while wiping away tears. "The abuse was devastating."
Weber's testimony should factor heavily into whether Lokuta is found guilty of violating the Pennsylvania Constitution and Code of Judicial Conduct. The Conduct Board gave it's side of the story this week. It will be Lokuta's turn when the Pennsylvania Court of Judicial Dicipline reconvenes Dec. 10 in the state capital.
"I have the most elegant and scholarly attorney," Lokuta said. "I'll leave the rest in God's hands."
Sinatra (Lokuta's lawyer), was confident the Board did not prove its case.
"I'm very satisfied with this week, within the context of the board; it had the burden of proof and this is the best they can do?" the Philadelphia based attorney said.
"And it's going to get worse," Frank Puskas, deputy chief counsel for the conduct board, disagreed with Sinatra's statements.
"I had full confindence in all of our witnesses and I still have full confidence in al of our witnesses. They got out the facts in this case.
And one of those witnesses, Weber, made the most of her chance to confront Lokuta."
Weber testified that something as simple as a mistake on a memo would make her the target of Lokuta's wrath.
"That would be enough to get a complete tirade of anger and it would continue throughout the whole day," Weber said.
In another incident, Lokuta screamed at Weber for deciding to unplug a Christmas wreath because the power cord was lying in a hallway where people could trip. Lokuta would also use an intercom system within the chambers to repeatedly buzz for updates on multiple work assignments she would issue a few minutes apart, Weber said.
"She would just be screaming at me," Weber said, "This was not a scolding, this was screaming."
During a 90 minute cross-examination, Sinatra suggested Weber threatened Lokuta with the Conduct Board investigation to keep her job. A similar threat was made because of Weber's age.
"Do you remember conversations with others present when you said (to Lokuta), you can't fire me because of my age?" Sinatra asked.
"No," Weber responded emphatically.
Sinatra also had Weber read thank you cards and notes to the judge during two periods of employment between 1996 and 2004, including a laudatory thank you note she wrote Lokuta for jewelry the judge gave her for her 50th birthday.
As for the case, when it resumes in December, witnesses will also be a critical component of Lokuta's defense. She has up to 70 people she plans to call, including herself.
The testimony could include references to a purported federal investigation Sinatra insists the Conduct Board's Complaint is in retaliation for Lokuta's participation in that alleged investigation.
Puskas pledged to "have a few questions" for Lokuta should she take the stand.

A former employee of Luzerne County's Judge Ann H. Lokuta, testified Friday she did chores at the Judge's Dupont home while she was supposed to be working inside the courthouse.
Judith Flaherty says she went grocery shopping, shovelled snow, performed yard work and cleaned upstairs floors before her employment ended with Lokuta in March 2001. Flaherty testified she scrubbed one floor on her hands and knees after Lokuta implied the end result would be better.
"I thought to myself, I'll do it on my hands and knees because I don't want to get her mad," she said.
Flaherty was afraid of Lokuta, she said she never protested doing chores.

Wow! Well, it shouldn't surprise anyone. Power corrupts and absolute power corrupts absolutely.

There's a manhunt out for Chester Stiles, the child molester accused of molesting a three-year-old girl. But, all I keep seeing, now, on TV is about Britney Spears losing custody of her kids to her freeloading ex-husband. Where can anyone find substantive information these days? I want to know how close they are to catching Chester the creep and the rest of the slugs on the planet. I want to know when they will finally connect the dots and make laws that resemble each other across the fifty states so that these creeps can stay locked up for good.

It's almost like we are being violated by the media and air waves to listen and watch Britney Spears and Fed-Ex or K-Fed. Kids are being killed, molested, abused; our soldiers are dying in war every day, people don't have jobs, women are being beat up by batterers, yet all we keep hearing is stuff about Britney. Those judges who keep appearing on TV, all decorated and trying to look sexy as whatever scandalous news person ask them questions about Britney, should be ashamed of themselves. They got rich off of selling the private lives of people in their choreographed courtrooms on TV and now they want us to take what they say seriously, which is not likely after that ridiculous Judge Larry Seidlin in the Anna Nicole baby drama.

Britney can hire nannies to do a better job than she can. Where's the news coverage on all the dead or molested kids who never get justice?

There was another child abduction attempted in Monroe this week. They treated it like it was the first time that that was reported to the police since the summer started. My friend's kids were chased for blocks by a man recently and in the same place as the recent attempted abduction. Except, it was that corrupt court's fault for allowing the kids' child molester father access to them. What they don't seem to realize is that if child molesters are horrible enough go to bed naked with kids, molest children, and expose them to pornography, they are just as bad when the negligent and corrupt court allows the child molesters acces to hang out on the streets with kids. It's a no-brainer, you IDIOTS! This excuse for a court of law gave my friends' kids to the child molester father and when the kids refused to go with him, he left them in the parking lot. The kids were chased by someone but when it was reported to the court, the same lawyer turned judge that someone mentioned on this thread blamed the mother and said she was influencing the kids... That's that PAS crap that keeps popping its head up in child custody cases in Monroe and other parts of the country even though the creator of this "junk science," Dick Gardner, stabbed himself to death in the neck and throat after so many of the kids he put back in the hands of their child molester fathers were re-molested. This guy, Dick, believes in some of the stuff that NAMBLA: http://www.nambla.org/ (North American Man Boy Love Association) does. This group advocates sex between men and boys, and Dick must have been one of their Board members cause what this quack wrote seriously resemble NAMBLA's child molesters. Here's to the good old U.S.A. One country that allows this stuff to go on and actually gave NAMBLA a .org organization--it's NATIONAL!!!!

We haven't come that far as for children and women's rights. As a matter of fact, we are just about back at the Dark Ages. The courts are mostly controlled by white, racist and intolerant men. Monroe is right up there as number 1 in that corruption link. Shame on the rest of the good people who elected these morons, even though they bribed and corrupted their way in to be judges. They make all these promises, mailing stuff out to people to vote for them and when they get in there--for 10 years (10 years!!!!)--they kick the butts of the stupid people who voted them in or the ones who stayed away from the polls.

We should start to watch out for when these people are up for re-election. I know one of the evilest ones is coming up soon. Judge Worthington should be into her 7th year now. We should start a petition to remove all three of the conciliators. This job should require voting too or at least they should be evaluated from time to time. In fact, they should make it mandatory that judges and all others involved in making decisions about other people's kids are evaluated by experienced, unbiased, objective mental health professionals from outside of Monroe County.

I love it when they talk about "family values." It has so much legitimacy, nowadays, doesn't it? The poster on this thread was right--the most law and order types are always the ones doing the worst things. I guess these "family values" people really meant that the term was not about doing right by your family but rather synonymous with waste material for maggot consumption.

Tragic stuff on here. People have the right to get petitions going when the justice system works only for the crooks, cheats, and liars. If the judges are there for 10 years, get a petition to shorten the time and leave it in daycare centers and catch people at the post office, etc. Get it on ballots in the election. Once the public hear about the crap, they'll jump in, they just have to know about this stuff. Get another petition out to get rid of some of the crooks on the bench in your town. You can even start petitions online (email).

Did you all see that piece on CNN with that Richard Herman loud-mouth so-called law professor? He's just like that other Dick, Dick Gardner, the PAS doctor. You can just guess what this loud-mouth, abusive to your ears nut is teaching young men in his classes.

You all should read the page by Lavar and Pam, it's called "Politics In Distractions." Dick Herman said the court is tilted towards women, but he's a big, fat liar. Majority of women don't live high on the hog after divorce and if they're lucky to get alimony, it does little for them and their children's survival, they mostly live in poverty. They're saying majority of women, 67% live in poverty with their children.

CNN showed one side only. I guess we should be used to this biased reporting by them by now. They did a thing on this guy and his convict wife, who is in jail for beating and killing her son. If this woman is guilty, she will be an ex-convict and shouldn't get alimony. But men who are ex-cons still have access to children. Men who beat their wives to near death still have access their children. There's a lot more battering going on on women than men having to pay child support to ex-con females. These freaking morons keep spinning lies on television because they want to abolish not only alimony but child support, as well. They're making headway with this stuff too. Many states have no-fault divorce and since 67% of women live in poverty, some after divorce, how the hell can this loud mouth Dick Herman be the only voice spinning lies on CNN without anyone to challenge his B.S.?!! The men who control the airwaves and cable news are abusive bastards. And the women producers who push this garbage to the public all suffer from daddy complexes/issues. They just refuse to get the help that they need. Until then, we will never be able to have honest debates about these issues that hurt women and children.

CNN had Dick Herman on again. Not only are they biased and pushing Hillary Clinton to the forefront in polls and glossy reporting, the female reporters/producers are self-destructive and think they are above the average female.

Their comfort level will dramatically change if and when they are faced with divorce court and in a child custody case. They'll get that rude awakening of which way the court is actually tilted and then they'll see if the boys at CNN will run stories about the gender bias that so many women experience in the American family court system.

Americans are feeling the pinch in every way possible. The housing market is a catastrophe. The U.S. dollar is at an all-time low. Peter Schiff, on the Glenn Beck show (I know, I hate to quote his show on anything), said the government is lying to us when they say inflation is at 3%. He said people went out and spent borrowed money on Black Friday. Like drug addicts, people continue to spend in addictive ways. Everything is more valuable than money these days so that sounds like inflation. It's simply a mirage that things are going well and there's money to spend when so many people are without jobs. Recession: when the state of the economy declines; a widespread decline in the GDP and employment and trade lasting from six months to a year. The predictions are so dire that it seems closer to depression: a period of drastic decline in a national or international economy, characterized by decreasing business activity, falling prices, and unemployment. It's been reported that Europeans are coming by plane loads to purchase items that we imported from them. They arrive in large numbers and purchase items with the stronger EURO dollar. Baby Boomers will retire with less money to live on. Some will have to work past retirement age just to survive.

The news reports are mostly jumping on board with reports that Iraq is doing so much better. Here's the trillion dollar question: How long will our military have to stay in Iraq in order for Iraq to do better? This, I believe, is relevant because it doesn't make sense that Iraqis would want to live for the rest of their lives in a military state of foreign occupation. Will we continue to fall for more lies from our government and the media? Correct me if I'm wrong but 180,000 is the number of American soldiers believed to be in Iraq. With that many soldiers away from their families and now living full time in Iraq, our military would have to get the job done. So when can they come home? The answer seems to be they won't be able to come home if they are to keep the powder keg from erupting in Iraq. How am I doing so far? They finally put enough soldiers in the disaster to calm the storm, but how long must this be maintained so others can claim success?

Companies behaving badly:

The latest company to employ sweatshops and take advantage of people in poor countries while taking jobs away from Americans is: Victoria Secret. But they've been doing this for a long time. I found this on Victoria on AlterNet:

D.K. Garments is a subcontract factory with 150 foreign guest workers (135 from Bangladesh and 15 from Sri Lanka), which has been producing Victoria's Secret garments for the last year. None of the workers have been provided their necessary residency permits, without which they cannot venture outside the industrial park without fear of being stopped by the police and perhaps imprisoned for lack of proper documents.

The Victoria's Secret workers toil 14 to 15 hours a day, from 7:00 a.m. to 9:00 or 10:00 p.m., seven days a week, receiving on average one day off every three or four months. All overtime is mandatory, and workers are routinely at the factory 98 to 105 hours a week while toiling 89 to 96 hours. Treatment is very rough, as managers and supervisors scream at the foreign guest workers to move faster to complete their high production goals.

Workers who fall behind on their production goals, or who make even a minor error, can be slapped and beaten. Despite being forced to work five or more overtime hours a day, the workers are routinely shortchanged on their legal overtime pay, being cheated of up to $18.48 each week in wages due them. While this might not seem like a great deal of money, to these poor workers it is the equivalent of losing three regular days' wages each week.

Workers are allowed just 3.3 minutes to sew each $14 Victoria's Secret women's bikini, for which they are paid four cents. The workers' wages amount to less than 3/10ths of one percent of the $14 retail price of the Victoria's Secret bikini. This is really a shytty thing because it's bad enough identity theft is bad in America but how much safer would you feel having to give your social security number, address, and other personal information to someone in another part of the world? It happened to a friend of mine who applied for a Chase credit card with a Philippino woman over the phone, and three weeks later, Chase had no record of my friend's credit application. She said she was on the phone with this woman for about an hour, and mainly repeating, over and over again what she told her. Now, she's worried and wondering who she gave her personal information to and what will happen to her credit (she's pulling all her credit reports from all the reporting agencies). Chase has a hand's off approach to the whole thing. They could care less even though they are the ones who directed my friend to call this woman in the Philippines by making it their customer service center. THIS IS SOMETHING BIG THAT WE SHOULD ALL BE CONCERNED ABOUT. WHO ARE WE GIVING OUR PERSONAL INFORMATION TO WHEN WE CALL A SO-CALLED AMERICAN COMPANY BUT END UP ON THE PHONE WITH SOMEONE WHO SPEAKS ANOTHER LANGUAGE AND VERY POOR ENGLISH AND IS MOST LIKELY OPERATING FROM SOME MAKESHIFT ROOM IN ANOTHER PART OF THE WORLD? BANKING DEREGULATION ONLY WORKS FOR RICH GUYS AND CAPITALIST GLUTS.

IBM sent thousands of American jobs to India. Colgate Palmolive did the same thing. Although Siemens ICN is a German company, they make a ton of their money here in America and from American consumers, but their plans for America included importing Indians to do the work here. Americans even had to train their Indian replacements in order to receive severance pay, read about "One man's crusade against outsourcing American jobs."

Anyway dudes and dudettes, that freak, Dick Herman, was back on CNN again, but this time he was on the Nancy Grace show with that woman that's filling in for Nancy out on maternity leave. This Dick guy did it again! The black pregnant woman, Karyn McConnell-Hancock, who went missing last week from Ohio turned up in Atlanta, Georgia. She said she was abducted by 2 guys and a woman; they duck taped her mouth, stole her car, and later dumped her off in the street in Atlanta. She's a lawyer with her own law firm and she's been getting threatening phone calls for a while. She went missing after she didn't pick up her three-year-old child (I'm not sure, son or daughter) at her daycare, and they called her husband who's a bishop with a local church. Before the woman was found, CNN aired a story about her, and her dad, who is a judge, was on the Nancy Grace show asking for anyone to tell what they know about his missing pregnant daughter. The woman filling in for Nancy had the good sense not to have Dick Herman on as the only so-called expert "opinionated" lawyer. They had another woman lawyer on (I think she was an ADA). Dick opened his big mouth after the missing woman's dad spoke and said that she was being sued for $10,000 and she must have ran away to avoid having to pay the money. Can anyone imagine that?! This guy had no concern for the 6-month pregnant mom and as soon as he got his woman-bashing opportunity to respond, the first thing out of his mouth was something hateful. I hope her father, Judge McConnell, sues the bastard for defamation or gets his daughter to sue him. CNN quickly went to commercial and then that woman in for Nancy said that there was no lawsuit pending against the woman (it hadn't surfaced yet or is just not out there). She tried to do damage control after the freak (Dick Herman) had spoken. I'm sure her dad, the judge, could easily sneeze out $10,000 if he had to to make a lawsuit for his pregnant daughter go away. Dick is a freak of nature.

Here's my personal take on Dick Herman: he obviously was rejected by women, several times, throughout his life. Until he started popping up on shows like CNN, he probably couldn't afford to pay for dinners with pretty women. Dick is a needy little bastard and most likely never got the attention he craved from his mother, therefore, all women must fill this role in his life until the emptiness is padded with all the attention the little bastard craves. Dick may have been locked in a closet as a child. Dick craves any form of attention he can get, thus, the outrageous, nonsensical, loud, woman-bashing comments that frequently escapes his mouth. Dick apparently has a Phil Spector diagnosis (that's that dweeb freak who always wears those weird wigs in public and killed that actress, Lana Clarkson by shooting her in her face, point blank). Dick hates women. Dick may also be a gay Republican (and we know how much they like to stay in the closet with their wives and children as they gay bash and go trolling around for male prostitutes and young pages on Capitol Hill).

Nancy Grace seems to pander to the Fathers' Rights guys from time to time. Case in point, her rerun this week had a story on about a man who shot his wife's young lover whom she had been a teacher to when he was 17 or 18. The man's on trial for 2nd degree murder. The wife wasn't charged for sleeping with the 17 or 18 year old. The couple has young kids and Nancy asked (well, she more like made a statement) about if it had been a man who had done this, supposedly the court would have stopped him from having the kids. AAAAAHH!! What a crock!! I guess Nancy needs to visit P.A. where a judge gets to oversee child custody cases while he's on trial for molesting his own 10-year-old daughter. The only difference in these minor popping-up of female sex offender teachers is what the judges see as "rites of passage" for the young boys whom they have sex with. And the "4 or 5" teachers accused and or convicted of this stuff, that's been in the news, are nice looking so sexist judges will just think the boys got the treat that they would soon get anyway. I don't think that that means the court is tilted towards women. There's also the fact that these women have been young, white females. Had they been Black, Mexican, Arab, the way the mostly, White, male judges see them could have been altogether different. So what's going on is judges with twisted male ego thinking that these young men were given the "rites of passage" and got laid by older women and the fact that they were young, pretty, white women made all the difference.

I think people should get involved with their local elections. Most people only get in gear when there is a national election. That is when the two party system get the word out about the candidate they want people to vote for. They don't willingly share information about various candidates at the local level. Most people don't know who their elected judges are, or who their school district board members are. These are the people who are making the crucial decision on the average person's life. Now that so many young people went out to vote in the primaries and hopefully will in the national election, grassroots effort should get ramped up to keep information free-flowing for local elections too. Empowerment starts at the grassroots level. Then people will get to know the people who make decisions about their day to day lives instead of when they have to go to court and meet a screwed up judge, or a principal who was hired by some school board system with status quo people. School board district members are voted in and these (mostly older white guys) tend to have businesses that somehow get these million dollar contracts to work on the same schools they are supposed to be in charge of (manage). I call that a major conflict of interest in the worse way. The status quo people will keep voting for the status quo officials if people don't rise up and make their presence known.

I like to think that as Christians we should always
forgive the sinner even as we condemn the sin.

However, what I, what we, think and believe seems
difficult to accept at times especially when it comes to those who so grievously offend.

Feigley’s horrendous crime wasn’t simply rape, if any rape can be termed “simple.” He not only raped three defenseless kids, depriving them of their innocence, but he did those acts under the pretense of being their pastor/advisor/protector.

I don’t offer, I can’t offer, a solution to him that will make his remaining years peaceful and uneventful, given the nature of his crimes. I can only suggest that he consider relocating to an isolated location where he can never be tempted to repeat them.

Thirty years is a long time to be imprisoned but for those three victims the rest of their lives, hopefully, will be far longer and their lives were forever changed by George Feigley.

Our system is stuck in testosterone mode. The family values types are in race car mode and driving us over a cliff. These guys are out of control!!! They get paid as judges and mediators to make decisions about kids lives but they won't do their jobs. Kids fall through the cracks because these a*s wipes get jaded by the system they help corrupt and won't pay attention to individual cases coming before them. They run for office swearing to do right by the people but never come close. They develop this one size fits all mentality--screw the oath they took to do their jobs. Even though some of these judges are just put back in their posts, we can still pay attention to when their names come up on ballots and vote "NO" to their retention. We can organize and get the word out at polling booths. WE CAN DO SOMETHING SIGNIFICANT ABOUT THEM. VOTE "NO" ON ALL THE JUDGES UP FOR RE-ELECTION IN YOUR TOWNS WHO ROUTINELY PUT KIDS AND WOMEN'S LIVES IN DANGER!

My name is Shirley Riggs, I’m 39 years old and the mother of 4 beautiful children. I’m writing this inside the Thurston County jail, Olympia, WA, waiting for extradition to Kansas City, Missouri to face charges of custodial interference. My bond stands at $500,000 cash only. SCRANTON – For more than a decade, Mark Ciavarella and Michael Conahan served on the Luzerne County Court of Common Pleas, developing reputations as hard-working judges.

On Monday, federal prosecutors revealed the longtime jurists were allegedly working equally hard behind the scenes on a far less noble endeavor – enriching themselves at the expense of the public and juveniles who appeared in Luzerne County Court.

They did so in the form of kickbacks -- $2.6 million worth – that U.S. Attorney Martin Carlson said were paid to the judges by two unnamed people in exchange for favorable judicial rulings regarding the PA Child Care juvenile detention center in Pittston Township, and its sister facility, Western PA Child Care in Butler County.“This is a sad event when individuals who took an oath violate that oath and violate the law,” Carlson said at a Monday afternoon press conference at the federal courthouse where he announced charges of conspiring to defraud the IRS and devising a scheme to defraud taxpayers of their honest services had been filed against the jurists.

Carlson said Ciavarella, 58, and Conahan, 56, have signed plea agreements that call for them to serve 87 months in prison and to pay a yet-to-be-determined amount of restitution.

The judges have also agreed to resign from office within 10 days after the court accepts their pleas, and will immediately be disbarred from practicing law. Ciavarella resigned as president judge on Friday.

The maximum combined penalty for the two offenses was 25 years in prison and up to $500,000 in fines. Carlson said he believed the plea deal that was worked out serves justice.

The charges stem from a more than two-year investigation by the FBI and IRS that uncovered a “flagrant violation of public trust,” said Leslie DeMarco, special agent in charge of the IRS criminal investigation unit.

“They sold their oath of office to the highest bidders and engaged in an ongoing scheme to defraud the public,” Deron Roberts, chief of the FBI’s Scranton office, said at the news conference.

The 22-page complaint details an elaborate scheme the judges developed to ensure PA Child Care, then owned by Butler Township attorney Robert Powell and Gregory Zappala, prospered financially. Gregory Zappala is the son of former Pennsylvania Supreme Court Justice Stephen A. Zappala.

According to the complaint:

Conahan removed funding for the county-operated juvenile center on River Street in Wilkes-Barre in 2002, ensuring its closure. The county began sending youths to PA Child Care when it opened in February 2003.

Just prior to its opening, Conahan signed a “placement guarantee agreement” with the facility that guaranteed the courts would pay an annual rental installment of $1.3 million.

Ciavarella, the county’s longtime juvenile court judge, helped ensure PA Child Care had a high occupancy rate by, at times, ordering children be detained there even when the juvenile probation department felt it was not necessary.

Ciavarella did that in part by establishing a “specialty court” that created a potential for an increased number of juveniles to be sent to PA Child Care.

The judges’ actions assisted the two juvenile centers in securing agreements with Luzerne County that were worth “tens of million of dollars” for the placement of juvenile offenders, the complaint says.

The complaint also describes how two others involved in the scheme – identified as “participant 1” and “participant 2” – funneled money to the judges by disguising the payments as a “broker fee” or as falsely portraying them as rental payments for a Florida condominium.

Carlson would not identify the two participants, but details contained in the complaint indirectly identify them as Powell and Robert Mericle of Mericle Construction, the contractor who built both the PA Child Care and Western PA Child Care facilities.

The complaint notes that in June 2000, Ciavarella had a conversation with a Luzerne County attorney “who was interested in constructing a juvenile detention facility” in the county. Ciavarella then introduced that person to a contractor, a friend of Ciavarella who was later hired by that attorney to build the center.

The complaint also notes several transfers of funds that were made by Mericle Construction and Vision Holdings, a company owned by Powell, that prosecutors contend were made to conceal payments to Conahan and Ciavarella.

No charges have been filed against Mericle, Powell or Zappala. Asked if any more charges were forthcoming, Carlson would only say the investigation is continuing.

Powell could not be reached for comment Monday. In prepared statements, Mericle and Zappala, who bought out Powell’s interest in the centers last June, denied any criminal activity.

“At no time did Robert Mericle or Mericle Construction ever make any payment to influence a decision to secure a contract to build any PA Child Care facility,” said Lew Sebia, general counsel for Mericle Construction. “Mr. Mericle has cooperated with authorities with respect to this investigation and will continue to do so in the future without exception.”

William Brucker, attorney for PA Child Care, said Zappala did not have “any knowledge whatsoever of the actions” described in the complaint.

“I can confirm only that no charges have been brought against the companies or its principal owner, Gregory Zappala, and that none are anticipated,” Brucker said.

Ciavarella’s attorney, Al Flora, of Wilkes-Barre, said Ciavarella and Conahan also dispute some of the allegations contained in the complaint.

“The information you have before you constitutes the government’s allegations. It is not an admission to all those allegations,” Flora said.

Flora explained the plea agreement is a “conditional plea.” The precise facts that Ciavarella and Conahan will admit to will not be known until they actually appear before a judge to enter their pleas, Flora said. No date has been set for that hearing.

At the time the judges appear in court, the U.S. Attorney’s Office will have to recite evidence in support of the various allegations, Flora said. Ciavarella and Conahan would then have to decide whether to admit to those particular facts, he said.

Flora said Ciavarella will not admit to all of the information included in the complaint. If the government presents facts in support of each of those allegations, Ciavarella will not agree to enter the plea, he said.

“I can tell you, Judge Ciavarella will not admit to every one of those allegations,” Flora said.

Flora said he is also speaking on behalf of Conahan, who is represented by attorney Philip Gelso. He said he believes Conahan also will not admit to all of the allegations contained in the complaint.

It was not clear Monday whether the case will be heard by a judge sitting in Scranton, or be transferred to a jurist within another section of the Middle District, such as Harrisburg or Williamsport. The case is being prosecuted by Assistant U.S. Attorney Gordon Zubrod.

Conahan and Ciavarella will remain free pending their court appearances. Asked why the judges were not immediately taken into custody, Carlson said it is standard procedure to allow anyone charged with a “white-collar crime” such as this to remain free until they are summoned to enter the plea in court. He stressed that all proceedings involving the judges will be public.

“While some might wish for a moment of high drama, that sort of perp walk … justice requires us to deal with these defendants like we would every other defendant in a similar situation,” he said.

Stressing the investigation is continuing, Carlson called upon anyone who may have further knowledge relating to the case to contact the FBI or IRS.

Injustice in Colorado

I have a story about what happened to me in Lincoln County, CO. Here it is in a nutshell, along with a couple of newspaper articles and radio interviews:

• African American writer living between Los Angeles and NYC and have never resided in Colorado. English B.A. UCLA, recently accepted into graduate school for Global Affairs - Norwich University, Vermont . First book, on Creole culture, to be published in 2009.
• Falsely arrested in Limon, CO, in 2006 regarding a dispute with the Santa Monica, California car rental company, Rent-4-Less, that committed theft on my debit card and provided false information to the Lincoln County D.A. The car was reported stolen unbeknownst to me, though I’d been in contact with the company.
• Held in Lincoln County Jail in Hugo, CO, for 6 months. Was initially allowed to communicate by making phone calls, but eventually discovered my mail and other communication was being withheld and interfered with. Had a felony put in my file, was able to disprove that once I was out. Discovered that local bondswoman, Marge Bishop, who was friends with guards at the jail and the secretary, Beverly, in the D.A.’s office, was calling around telling people not to help me because I was a “felon” from California and I “didn’t understand how things worked” down there.
• Referred to as "a menace to society" by the assistant D.A. (she told the public defender this, who was also very much in cahoots with them). This statement is a result of my confronting one of the jail guards about the corruption in this jail: Guards having intimate relations with inmates, favoritism, drug use by guards, guards discussing people's cases with other inmates, inadequate healthcare.
• At the Lincoln County Jail, I was referred to as "N" word, had the air conditioning turned on full blast on me during the middle of the winter and several additional forms of harassment. Was taken to the hospital, in shackles, for chest pains. Prescribed a dosage of Xanax that was far too strong for me.
• When I got out of Lincoln County Jail in the middle of winter, I discovered the Limon Police Department had gotten rid of all of my belongings. They said they kept my things in the car when it was shipped back, but this hasn’t been proven. My passport, clothes, business files (including my contract with Rent-4-Less, which was evidence), and other materials were all disposed of.
• Most recent request for an appearance in court on April 17, 2009, for payment on almost nine thousand dollar ($9,000), in restitution payments. These payments are a result of supposedly what I owe the car company. The location of Rent-4-Less I was dealing with is now closed. I flew down there five times, wanting to go to trial and refusing to take their plea agreement of two class three felonies. On my 5th and last visit there, in September of 2007, the public defender, John Becker, told me that if I took it to trial, I would be “hung.” That the jury there would send me to prison, (which is right over in Limon, CO), and that he didn’t care about me, he got to home. I have never seen such a disregard of the law as this guy displayed. He had no interest in representing me correctly or in my best interest.

Wow! Sonyaa2 your case sounds almost unbelievable. I can't believe you went through all of this and this is about a car rental! I hope you get some justice soon.
